Minor modifications made to Chick-fil-A Woodlawn Square renovations

On Monday District 2 Cobb Commissioner Bob Ott signed off on minor modifications for the architecture and canopy for Chick-fil-A Woodlawn Square renovations that will begin in July.

As we noted in December, commissioners approved the restaurant’s expansion plans in December that include a double drive-through with a canopy and subject to final approval from the district commissioner.

That’s standard practice on most zoning and site plan cases that come before the commissioners. What they’re not required to do is explain what modifications they make after the cases are approved.

Earlier this spring Ott said he would publicly post any minor modifications and any other sign-offs on zoning cases online and in his weekly newsletter:

This will allow you, and your neighbors, the opportunity to review the request and to see what changes are being proposed and to provide feedback to Commissioner Ott. Commissioner Ott will review the feedback that has been provided, make possible changes and will sign the document the following week.

The canopy and architectural renderings, as modified at the Woodlawn Chick-fil-A, can be found here. The changes pertain to side and rear elevation specifics of the canopy.

As we noted in March, the busy restaurant is closing in July for the renovations and is expected to reopen in November.

At tense Cobb budget retreat commissioners haggle over millage rate, spending cuts

One of the objectives laid out before a Cobb budget retreat on Tuesday was for county commission chairman Mike Boyce to “leave . . . with clear direction from the board.”

That board, the four district members of the Cobb Board of Commissioners, provided him with nearly everything but that in a three-hour meeting at the Cobb Civic Center. Instead, Boyce left openly frustrated as he begins a series of budget town hall meetings next week, starting Monday at the East Cobb Senior Center.

He’s proposed a millage rate increase he says will close a $30 million budget deficit that’s projected for fiscal year 2019. During the retreat, told the commissioners “if we want to keep what we have, the bill is 1.1 mills,” a reference to his recommendation to raise the general fund millage rate.

Revealed earlier are draft lists of possible closures of libraries, parks and other “desired” services that have galvanized public pleas to preserve them, and in some cases, by raising taxes.

Commissioners picked away at a number of budget expenses, such as the cost of new police vehicles, transferring operating costs for the Cobb Safety Village to the Cobb Fire Department and proposed Sunday library hours, unwilling to give Boyce an unqualified yes vote.

Bob Weatherford of West Cobb, who is in a runoff election the day before the budget is to be adopted in July, told Boyce that “you’re asking us to commit to something before we’ve had the town halls.”

Even South Cobb commissioner Lisa Cupid, his most reliable ally on the budget, wondered aloud about having town hall meetings to solicit more public feedback, since “every single e-mail references [full funding of libraries]. They’re telling us it’s a matter of priority.”

Boyce kept making the case that “I’d rather have something to take to the people.

“I have to pass a budget, but I also have to count votes,” Cobb Commission Chairman Mike Boyce told commissioners at the retreat.

“What I’m asking the commissioners is to join me in this program,” he said. “I get it. You don’t want to stick your neck out. But this isn’t hard.

“It’s $30 million in an economy of billions,” Boyce said, his voice rising. “You would think we’re living in Albania! I just don’t understand.”

Near the end, Boyce said even if the tax rate went up two mills, it’s still lower than most other local governments in metro Atlanta.

“We owe it to the people of this county to continue this level of service,” he said, suggesting that if they couldn’t, headlines would read that they’re closing things like parks and libraries.

Some county government department heads and staffers in attendance loudly applauded when he said that. Boyce received even louder applause when he said:

“I will pay a huge political price. But I’m willing to pay it. I don’t want to live in a county that’s worse than when I came here.”

After the retreat, East Cobb commissioner Bob Ott told East Cobb News that he “heard some frustration” and credited Boyce with providing more budget details than what commissioners have received in past years. Ott has said for several months that he wants to see more proposed spending cuts before he’s willing to consider a tax increase.

He couldn’t support a millage rate increase on the spot “because I haven’t seen the cuts.

“A lot of what he asked for today we heard in October” at the commissioners’ previous retreat, Ott said.

Ott doesn’t support closing any parks or recreation facilities that were disclosed last week and contained on a draft list of possible options for budget reduction. They include Fullers Park and Fullers Recreation Center in East Cobb.

“I’m not going to support closing something that is heavily used,” Ott said.

District 3 commissioner JoAnn Birrell said that “I have no interest in closing parks.” Birrell, who is up for re-election in November, told East Cobb News she’s eager for the town hall meetings to get more citizens’ input before budget deliberations begin in July. She said she’s received many messages both in support of and against a tax increase.

The Mountain View Arts Alliance is asking members to fight to keep The Art Place open.

“We’re still looking at everything,” she said, adding that “shutting down” items on draft lists “won’t add up to $30 million.”

On the draft parks and recreation list in her Northeast Cobb district are the Mountain View Aquatic Center, the Mountain View Community Center and The Art Place.

The Mountain View Arts Alliance, a non-profit citizens’ group that provides support for The Art Place, has distributed a letter urging its members speak out at town hall meetings and contact their commissioners:

“Increasing the millage rate would provide the funds necessary to close the 30 million dollar budget gap. This money goes toward programs ranging from road maintenance to emergency services to libraries to the PARKS department, which encompasses The Art Place as well as dozens of recreation facilities and public parks.”

The MVAA is also asking its supporters to “please wear your brightest blue to show support at town hall meetings.”

Cobb budget meetings begin with commissioners retreat next week

The month of June has been scheduled for Cobb budget meetings and a series of town halls, starting June 18 at the East Cobb Senior Center.

But before that, the Board of Commissioners will gather next week for a budget retreat.

That meeting is next Tuesday, June 12, at 1 p.m. in the Hudgins Hall Conference/Multipurpose Room of the Cobb County Civic Center (548 South Marietta Parkway).

Cobb Commission Chairman Mike Boyce has advocated raising the millage rate on property taxes as a way for the county to continue to deliver what he calls “five-star” services.

The county government is facing an estimated deficit for fiscal year 2019 of at least $30 million.

Boyce has initially suggested a millage increase of 1.1 mills (which would generate an extra $30 million in revenue) to the current general fund rate of 6.76.

In his weekly video update with county communications director Ross Cavitt (view below), he said that “1.1 mills just puts the finger in the dike.”

A full proposal to fund a balanced budget hasn’t been presented. However, the head of the county library system has proposed cutting nearly a quarter of the system’s $12 million budget and closing the East Cobb Library.

East Cobb’s commissioners generally have opposed property tax increases. Bob Ott of District 2 has said that he wouldn’t support an increase without seeing substantial cuts first. JoAnn Birrell of District 3 won her GOP primary last week after publicly opposing raising property taxes.

In the video, Boyce showed charts illustrating how Cobb’s millage rate has steadily come down over the last 25 or so years, being raised to address the recession. Two years ago, then-chairman Tim Lee, facing Boyce in a runoff, proposed an overall millage rate reduction to 9.85 (and 6.66 for the general fund) that passed, with Ott and Birrell voting with him.

“We have had a lower millage rate although our population has increased by more than 300,000” since the 1990s, Boyce said.

The town hall meetings are scheduled around the county, including another in East Cobb on July 9 at the Sewell Mill Library and Cultural Center.

Commissioners will hold public hearings on the budget and millage rate on July 10, 27 and 25, with adoption of both scheduled for July 25.

Cobb spending an additional $160K for engineering design for Lower Roswell traffic improvements

Long-delayed plans for Lower Roswell traffic improvements in the Johnson Ferry Road area are getting some action.

The Cobb Board of Commissioners last week approved a contract for $160,145 for additional engineering design work.

It’s the second time supplemental funding for design work has been approved for that project, bringing the total spending for pre-construction engineering to $650,000 in Cobb’s consulting contract with Smith Gresham and Partners.

The original contact was for $445,000. Cobb DOT said the extra funding was needed to “revise the original concept preliminary design and right-of-way plans.”

The project, which is the final phase of improvements in the Lower Roswell corridor, call for significant changes between Woodlawn Drive and Davidson Road, although no final plans have been determined.

They include a possible raised median along part of the route, longer turn lanes and improved traffic and pedestrian signals.

It was initially approved in the 2011 SPLOST (initial project summary here and project concept here) and Cobb DOT officials held public open houses in 2012 to tout the changes.

But it has run into snags from the beginning.

The major concerns were from business owners on the north side of Lower Roswell, east from Johnson Ferry to Davidson. A raised median is proposed, but has not been formally approved, to cut down on left-turn traffic coming out of Parkaire Landing Shopping Center.

District 2 Cobb commissioner Bob Ott told East Cobb News he wanted changes that would have “the least amount of impact on those businesses.”

He said early designs called for a service road from the McDonald’s on Lower Roswell to Davidson to accommodate access to those businesses, but that road is not going to be built.

Ott said the additional design work was sought since the original proposal was made so long ago. Because the project is SPLOST-approved by voters, it must be completed. There isn’t a timetable for the design revisions.

Right-of-way purchases also remain outstanding. The elderly occupant of an old white house facing Lower Roswell at Woodlawn has passed away in recent months, and property acquisition is still in progress.

The Lower Roswell project includes additional sidewalks as well as through and turn lanes in and around the intersection at Woodlawn.

The total cost of the project, when finished, is expected to come to $6.2 million, with nearly half of that right-of-way purchases.

JOSH community meeting Tuesday to detail ‘suburban-style’ image survey

On Tuesday another JOSH community meeting will solicit public input on continuing efforts to develop a Johnson Ferry-Shallowford master plan. A new image preference survey for possible future development in the area is the main subject, following protests from some that what they had to choose from was too dense.

The meeting takes place from 7-9 p.m. Tuesday at Chestnut Ridge Christian Church (2663 Johnson Ferry Road) and here’s what District 2 Cobb commissioner sent out on Friday about what’s on the agenda:

Previously, staff was scheduled to present a conceptual plan on Tuesday, May 8. Instead, staff will utilize the May 8 community meeting to facilitate the additional IPS.

The focus of the session will be a second Image Preference Survey that is concentrated on suburban-style development concepts. The survey will include more-specific residential, commercial and office development types that would be more typical of a neighborhood activity center and transitional areas within a suburban community. In addition, there will also be images reflecting greenspace and park options, stormwater management options, and streetscape elements.

Staff will still conduct an “Open House” format meeting to present the conceptual plan in upcoming months.

Jason Gaines of Cobb Community Development told us that final meeting has tentatively been scheduled for May 23 but that has not been announced as of now.

Revised Johnson Ferry-Shallowford master plan questionnaire to go out next week

After an outcry by some respondents to high-density choices in a questionnaire that’s part of a new Johnson Ferry-Shallowford master plan, county officials overseeing the project will send out a revised survey next week.

An “image preference survey” designed to get public feedback about possible residential and commercial buildings will be reworked to include more “suburban-style” options (as seen above), especially for housing, according to Jason Gaines.

Gaines, the planning director for the Cobb Community Development Agency, told members of the East Cobb Civic Association on Wednesday that he’s prepared a new survey that’s in draft form.

Many of the buildings shown in the survey were several stories high, alarming some residents who felt that their choices may be limited to structures that are better suited for urban areas.

“The goal was to learn whether people like or don’t like” the styles of buildings, Gaines said. “We’ve got to a little bit more to do but that’s okay.”

Gaines, who is spearheading a series of public meetings about the master plan (called “JOSH” to indicate the main street name in the Johnson Ferry-Shallowford corridor), said around 200 people have responded to the survey online, and the feedback has been wide-ranging.

The image preference survey has been a similar component of other master plan updates. Cobb commissioner Bob Ott, whose District 2 now includes the Johnson Ferry-Shallowford area, asked for a new survey to be drawn.

He told East Cobb News that the original survey was approved by a 20-person stakeholders committee that includes citizens and business owners in the JOSH area.

Ott said there are no outside consultants influencing the survey options, and that the work preparing the materials is all being done by county staff.

This is the fourth master plan project he has requested for his district, including Vinings, Powers Ferry and Johnson Ferry (whose design guidelines were adopted this week).

“We’ve done this three other times, and every time the community has been supportive,” Ott said. “It’s not about what we or the staff thinks. It’s what the community thinks.”

He admitted that sometimes the staff selections for a survey are “a shot in the dark,” but they’re done as much to learn what a community doesn’t want as much as what it prefers.

The final JOSH public input meeting was supposed to have been May 9 but Gaines said there will be another meeting, on May 23, to give citizens time to respond to the new survey.

In addition, Gaines said two stakeholders meetings will take place in June to analyze all of the public response before any formal action is taken to update the master plan.

Some Johnson Ferry-Shallowford residents can’t picture suggestions of their community’s future

When Cobb community development officials recently asked Johnson Ferry-Shallowford residents to respond to an “image preference survey” of potential future development in the area, the blowback was swift, angry and occasionally sarcastic.

Suggested photos contained in the lengthy survey (see examples below) included plenty of high-rise residential and commercial buildings that are typical in urban areas, sunny resorts and even other countries.

What they didn’t look like to a good number of those responders was anything like what’s in the suburban Johnson Ferry-Shallowford area now, or what they want to see in the future.

We reported last week about the “JOSH” community meetings that have been underway this spring, and in particular stormwater issues that have been plaguing the nearby Loch Highland community for years.

That’s just one of the many subject areas that community development staff is surveying. A final public input session is scheduled for May 9 at the Chestnut Ridge Christian Church (2663 Johnson Ferry Road).

To be sure, the image preference survey did include some photos of single-family dwellings and low-rise office and retail space that looks fairly typical for what’s in the East Cobb area that’s the subject of an ongoing evaluation by county officials.

But many posts over the weekend at the East Cobbers Against High Density Development Facebook group  (which has around 1,000 members) tore into much of what the survey was serving up, fearing that there weren’t going to be many other choices besides the high-density options they were asked to comment on.

A few examples of the sharp replies:

“Basically they’re saying we don’t have a choice in the sense of no traditional housing on normal sized, decent lots. They are steering us in their direction, none of which is desirable to the vast majority of us who prefer no high density and more neighborhood like.”

“Even the single family options were right on top of each other.”

“I don’t know why there is a question about what people want. We want what we had when we chose to move here. Single family homes, large lots with room for kids to play, good schools and low crime, libraries that were open etc., and that is slowly disappearing.”

“I tried to make sure they knew they were reaching: ‘Did Cobb lose a war to Romania?’ “

Office/retail/commercial building.

Cobb commissioner Bob Ott, whose District 2 now includes the Johnson Ferry-Shallowford community, weighed in on the Facebook group page, saying he had nothing to do with the survey selections and that what was being suggested was only to solicit feedback.

“This is not some consulting firm telling you what you have to accept. Let’s give staff some credit for taking this to the public for their thoughts,” he said.

To which a resident replied: “Then please give us choices that reflect homes on one acre lots. Nothing remotely resembling that was offered in the pictures presented.”

Similar image preference surveys have been done in previous corridor studies in Ott’s district, including the Powers Ferry Road area and Johnson Ferry Road.

We posted yesterday about the Johnson Ferry design guidelines that are coming up for commission adoption tonight, five years after they were presented. Those guidelines incorporate community feedback, and some of the generic photos in that presentation were included in the JOSH image preference survey.

Public space.

Some of the image survey responders simply asked that future development conform to the current and future land use plans in the area.

Ott said he would have the image survey redone. The original still exists, for now, and includes suggestions on sidewalks, cycling paths, greenspace, public space, stormwater retention ponds and more.

He also reminded citizens who thought their feedback was being sought for political reasons with primaries next month that he’s not up for election this year.

Wildwood Plaza townhome community gets approval; fate of aging trees TBD

The developer of a proposed Wildwood Plaza townhome community got rezoning approval on Tuesday after reducing the number of units and making other changes at the request of county officials and citizens groups.

But a major topic of discussion at a Cobb Board of Commissioners zoning hearing was how to replace aging pear trees that are part of the conceptual design for the office and residential complex off Powers Ferry Road.

The 5.6 acres of wooded area at the northeast intersection of Windy Hill Road and Wildwood Parkway, right across from the Towers at Wildwood Plaza, will soon feature the Ashton Woods townhomes. The land had been zoned for office-industrial use.

The applicant, Ashton Atlanta, received multi-family zoning (RM-12) and will build 60 three-story townhomes instead of 67, ranging in size from 2,100 to 3,500 square feet and featuring attached two-car garages. The developer also will stretch the width of units facing Windy Hill Road from 18 to 24 feet.

Those are some of the conditions approved by commissioners in their 5-0 vote, and after they had just received a revised site plan submitted on Monday. Another stipulation relating to the preservation of pear trees will be determined after District 2 commissioner Bob Ott confers with the county arborist.

During Tuesday’s hearing, Patty Rice, president of the Powers Ferry Corridor Alliance and a resident of the nearby Riverwalk at Wildwood community, asked commissioners “to do something to maintain the trees” within the landscaping plan that is part of the Wildwood Plaza project.

Those 15-story twin towers, built by Atlanta developer Tom Cousins in 1991, were designed by famed architect I.M. Pei, who wanted to preserve as much of the surrounding natural setting as possible.

Residential communities behind the towers maintain lush trees and landscaping amenities that blend in with the nearby Chattahoochee River National Recreation Area.

Some residents were concerned that Pei’s name wasn’t included in the Monday stipulation letter about tree preservation. Roughly two-thirds of the trees that line the triangular area around the plaza, including some on the newly rezoned land, are pear trees part of Pei’s original design.

Ott said that “the trees have reached [the end of] their useful life” and understands the desire by residents to replace as many of them as possible.

“I’m very familiar with what you’re trying to preserve,” said Ott, who has lived in the nearby Terrell Mill Road area for more than 20 years. More recent community activism, including the formation of the PFCA, he added, is the “reason we’re getting all the great things that we are.”

Other conditions of the rezoning approval, in addition to the trees, include Ott’s approving the final site plan, as well as fencing and wall designs and interior materials and elevations.

Ott town hall meeting scheduled for April 23 at SunTrust Park

If you missed Cobb commissioner Bob Ott’s town hall meeting held earlier this month at the Sewell Mill Library and Cultural Center (previous East Cobb News post here), you’ll have another chance in April.

He’s having his next town hall on Monday, April 23 from 7-8:30 p.m. at SunTrust Park. Ott’s District 2 includes the Cumberland/Vinings area as well as East Cobb, and citizens can ask about any topic pertaining to the district or the county.

Those topics figure to include the county budget, proposed library closings, transit and traffic, and the meetings tend to be lively and well-attended.

The town hall meeting will be held in the SunTrust Park Stadium Conference Room. The entrance is at the right field gate, and parking is in the red deck. The address for the deck is 2585 Circle 75 Parkway SE, Atlanta, 30339.

The Atlanta Braves open the 2018 season Thursday at SunTrust in a 4 p.m. game against the Philadelphia Phillies.

At town hall, Ott vows that East Cobb Library ‘isn’t going to close’

With the possibility of significant library cuts leading ongoing Cobb budget talks, District 2 commissioner Bob Ott was adamant on Monday that the East Cobb Library would not be among them.

It’s one of several Cobb library branches slated for closure or consolidation in a staff recommendation for fiscal year 2019, and one that has generated strong community opposition.

At the outset of his town hall meeting at the new Sewell Mill Library and Cultural Center, Ott said that “we’re going to dispel some serious misconceptions about the libraries.”

While the meeting included discussions about transit, zonings, county employee pay increases and tax assessments, many in the packed audience of around 300 people came out to plead for the preservation of the East Cobb Library.

The commissioners met last fall on a budget retreat and heard many recommendations for reducing a projected deficit between $30 million and $55 million.

The proposed library cuts of $2.9 million amount to a quarter of the department’s budget. Cobb commission chairman Mike Boyce has proposed a property tax increase of 1.1 mills, but few other major budget proposals have been made public.

That’s what Ott referenced as he held up a thick binder from the retreat at the town hall, held in the Sewell Mill Library’s black box theater:

“Have you heard anything else mentioned?” There are a whole lot of proposals that have come from staff, but [suggestions to cut libraries] gets everybody riled up.”

While the East Cobb Library doesn’t meet the county’s criteria for serving as a regional library due to being less than 20,000 square feet, because of its heavy use, Ott said, “we would all agree it’s a regional library.

“It isn’t going to close,” he said to loud applause.

The East Cobb Library is the third-busiest in the Cobb library system, with more than 250,000 materials checked out in 2017. It’s also the only branch that is in leased space, at the Parkaire Landing Shopping Center.

That rental expense is $263,000 a year, and it’s a factor that Northeast Cobb commissioner JoAnn Birrell cited when she suggested last year that the branch should close.

That got East Cobb residents in an outcry, and Ott was visibly upset in a town hall meeting he held at the library last summer.

“It’s been based on one commissioner who tried to close it, and she’s not here tonight,” Ott said Monday.

The East Cobb branch relocated from Merchants Walk in 2010, and leasing space at the time was considered more economical than building a county-owned facility, given local real estate prices.

When Ott was asked if it might be possible for the East Cobb Library to eventually get out of a leasing situation, he replied that “it’s a matter of finding the right opportunity.”

Ott opposes tax increases without finding savings in the current budget. Last year, he pressed for the closure of the business office at the East Cobb Government Service Center, a move that funded three new staff positions at the Sewell Mill Library.

He also mentioned the pending relocation of the Lewis A. Ray branch to the West Village development in Smyrna, which is offering 3,000 square feet of library space for $1 a year. That would save half the current operating cost of that branch.

“There are ways of doing this without raising your taxes,” Ott said.

Ott said that while many of his constituents contact him about right-of-ways and keeping medians maintained, his fellow commissioners hear often about keeping buildings open, including libraries.

“I don’t get e-mails about facilities,” he said. “You don’t necessarily want stuff. You want the place to look nice.”

He said that in order to ensure that the East Cobb Library stays open, he needs two other commissioners to vote with him. The budget is expected to be adopted in July.

“Send e-mails, not to me, but to the other commissioners and the chairman,” Ott said. “Let them hear what you think.

“You all know how to turn up the heat. Believe me, I’ve seen it.”

While the format is general in nature—he typically briefs constituents on county issues, and then fields questions from the audience—the upcoming budget process figures to be a major topic.

In particular, proposed library cuts are likely to be a high-interest subject. Ott’s last town hall meeting in August, at the East Cobb Library, came just as his fellow East Cobb commissioner, JoAnn Birrell, proposed shuttering that branch.

The East Cobb Library is on the list of proposed closures for the coming fiscal year 2019 budget, which is slated for adoption in July.

Commission chairman Mike Boyce has said he wants to hold town hall meetings related to the budget in the spring, but hasn’t announced any dates.

Cobb commissioners go on retreat to tackle budget issues, facing $20M gap

After a contentious year of haggling over the property tax millage rate and the fiscal year 2018 budget, Cobb commissioners are spending Monday and Tuesday on a retreat to figure out future plans for handling spending concerns.

Chairman Mike Boyce and the four district commissioners will be meeting at the Threadmill Complex in Austell for a day-and-a-half of meetings and discussions. Last month the board adopted a $403.4 million FY 2018 spending plan that included the use of $20 million in contingency spending.

The county is facing another $20 million deficit for fiscal year 2019.

“If you don’t know where you’re going, you’ll get there,” Boyce said in a statement issued Friday. “What I’m trying to do is bring in a process where we as a Board collectively knows what the issues are then the Board gives me some guidance on how to build this budget.”

The budget battles also sparked conflicts between East Cobb’s two commissioners. JoAnn Birrell suggested closing the East Cobb Library. Bob Ott, whose district includes the library, proposed closing another library in his district and making organizational changes to the East Cobb Government Service Center.

Ultimately, the commissioners voted to close no libraries but delayed funding additional staff for the new Sewell Mill Library and Cultural Center until after the budget was adopted.

For similar reasons this week, commissioners also delayed a vote to approve a construction contract for Mabry Park.

The Sewell Mill Library and Mabry Park cases center around one of the main items on the retreat agenda: Funding recurring operational and maintenance costs for facilities approved through the SPLOST (Special Local Option Sales Tax).

Northeast Cobb residents have waited for a decade for a passive park in their community, and Boyce and Ott in particular pledged that Mabry Park would be built. They also were adamant that new policies for funding continuing expenses have to be ironed out.

It’s a seemingly perplexing position for Cobb commissioners to be in, given that Cobb reported a record tax digest this year of $33 billion.

In the first big test of his administration, Boyce didn’t get enough support from commissioners to raise the property tax millage rate. His proposal to boost the rate 0.13 to fully fund the 2008 Cobb Parks Bond Referendum was voted down 3-2, with only South Cobb commissioner Lisa Cupid in support.

Boyce, who defeated incumbent chairman Tim Lee last year, pledged to support parks funding. But the Cobb Parks Coalition issued a statement before the millage rate vote saying fulfilling the referendum didn’t require a tax increase.

At a heated town hall meeting in July at the East Cobb Senior Center, many residents spoke out against a tax hike, which Ott and Birrell also opposed.

Boyce, who is a first-time elected official, issued a comment at that meeting that has been a common refrain at times during his first year in office.

“I have to pay for what your commissioners passed last year,” Boyce said. “It’s a bill that’s come due.”

Mabry Park construction plans delayed again, will be reconsidered in November

Not for the first time, Mabry Park construction plans have been put on hold. The three members of the Cobb Board of Commissioners who voted on Tuesday to table the item are pledging that it won’t be for long, but that it must be done.

The Northeast Cobb commissioner who fought long and hard for her community to have a passive park doesn’t think any further delays are necessary, even though this one may be for only a month.

“It’s long overdue,” commissioner JoAnn Birrell said, choking up with emotion and pleading for her colleagues to approve a $2.85 million construction contract at Tuesday’s regular meeting. “I see no reason to hold this.”

By a 3-2 vote, however, the commissioners voted to table approval of the contract, to Integrated Construction and Nobility, Inc., with the measure slated to be taken up again on Nov. 14.

Commission chairman Mike Boyce wants Mabry Park and other projects approved by voters through SPLOST referendums to be reviewed for long-term operations and maintenance costs, since that funding comes out of the annual county budget.

The SPLOST impact statements and a policy proposed by Boyce to govern them are among the topics at a commissioners retreat next week. That’s why Boyce said he sought the delay.

By law, projects approved via SPLOST (Special Local Option Sales Tax) must be funded. How to pay for their recurring expenses has been a vexing one for commissioners, who recently voted to spend $20 million in reserve money to balance the fiscal year 2018 budget.

“The project that got caught between a rock and a hard place is Mabry Park,” Boyce said. “We’re going to commit to these parks, but we have a bigger problem here and we need to solve this now.”

Boyce was supported by East Cobb commissioner Bob Ott, whose district now includes Mabry Park, and Bob Weatherford.

Tabling the Mabry Park contract approval comes a week after the commissioners hotly debated additional funding for the new Sewell Mill Library and Cultural Center, another SPLOST project that has more staff and higher operational costs than the East Marietta Library it is replacing.

The Cobb Department of Parks, Recreation and Cultural Affairs has indicated that once that complete, Mabry Park will incur an initial one-time cost of $22,230 for maintenance tools and equipment. Starting with the fiscal year 2019 budget, ongoing annual expenses are estimated to be $104,922. Of that total, $73,122 will go for staff salaries and benefits, and another $31,800 is projected for utilities and operational supplies.

Birrell cited the decade-long process of SPLOST approval, the development of the park master plan and the formation of the Friends of Mabry Park citizens group, which has raised more than $60,000 to help fund the project, located on 26.5 acres at Wesley Chapel Road and Sandy Plains Road.

“It’s a crying shame that we’re still discussing the construction of Mabry Park,” she said.

But Ott, who inherited the Mabry Park area this year due to redistricting, said it’s prudent for a delay so the board can work through the impact statement policy.

“We cannot continue to build things and not open them because they’re not funded,” Ott said.

He also pointed to unfinished projects in his district, including Hyde Farm (whose proponents have raised more than $350,000) and shifting $1 million in sidewalk funding as part of a series of “very difficult” decisions that have had to be made because of existing commitments.

Hania Whitfield, a former executive board member of the Friends of Mabry Park, was one of several citizens who spoke Tuesday to urge the commissioners to approve the construction contract.

“Many have lost faith they will be able to use the park,” especially seniors, she said. “There is an indisputable lack of green space access in the Northeast Cobb portion of the county.”

Boyce, supported by parks advocates during his successful campaign last year to oust former chairman Tim Lee, said the need to hammer out an impact statement policy can’t be postponed.

“We have to stop and put this together,” he said. “We have to start with something.

“Once we get this process in place, we will never have this problem again.”

Sewell Mill Library funding approved; East Marietta branch to begin closure

After a brief but sometimes testy conversation Tuesday morning, the Cobb Board of Commissioners approved the completion of funding for the new Sewell Mill Library and Cultural Center on Lower Roswell Road.

The board voted 3-2 to spend $284,227 to fund five full- and part-time positions for fiscal year 2018 in order to proceed with the opening of the new facility on Dec. 4.

Operations at the East Marietta Library, located adjacent to the new Sewell Mill branch, are expected to wind down this week.

The funding includes the transfer of $94,491 from the budget for the East Cobb Government Service Center, which will move some of its business office functions to the tag office in the same building (previous East Cobb News post here).

Ott said he worked with staff from the Cobb library, parks and public services staff to pare down the price tag for the Sewell Mill Library funding from around $700,000 to less than $300,000. The funding source is from “one-time monies” that has become a touchy topic on the commission as it voted this summer not to raise the property tax millage rate and as it adopted the FY 2018 budget with nearly $20 million in contingency funding.

That approved budget didn’t include Sewell Mill Library funding. Ott and Boyce said the county was obligated to move ahead with the transition now due to contractual obligations in demolishing the East Marietta Library building, creating a parking lot for the new library and rebuilding the road that leads into the adjacent Sewell Park.

“The reality is we have a $10 million investment the board has known about for years, and it’s been dropped in my lap,” Boyce said, then veering into a philosophical statement.

“Libraries reflect the culture of our society,” he said. “It is important to open up this facility that residents have been expecting for a long time.”

Birrell and Cupid objected to funding the Sewell Mill Library now, saying they wanted take up the matter at a commissioners retreat later this month. Birrell suggested a delay in opening the new branch until January.

“I understand that we can’t build things like this and then leave them empty,” she said. “My concern is the timing.”

Cupid concurred: “Why this can’t wait another 20 days is beyond me.”

She cited other unmet funding requests—including Cobb non-profits, the purchase of police body cameras and wish lists from other government agencies—as equally valid, and questioned the wisdom of using contingency funding for sustained expenses.

“There’s no way of knowing if we’re going to have this money year after year after year,” Cupid said.

Ott, who had suggested closing another library in his district, the Lewis A. Ray branch in Smyrna, to solve the contingency problem, became visibly upset.

“Don’t sit here and make inaccuracies,” Ott snapped, demanding that Cupid not interrupt him. “You did not reach out to address your concerns.”

Cupid said the finalized agenda item for Tuesday’s meeting came to her late.

Boyce said the vote over Sewell Mill Library funding is “the first of many battles we’re going to have” because the board voted against his proposal in July to raise the millage rate 0.13 mills (previous East Cobb News post here).

Weatherford said that amounts to just $4 million, or one percent, of the overall county budget, so “blaming everything on that vote is erroneous.”

Birrell, who had suggested closing the East Cobb Library during the budget process, reiterated her concerns of getting into a habit of dipping into contingency.

“We’re going to be digging a deeper deficit that we’re never going to overcome with one-time money,” she said.

Changes proposed for East Cobb Government Service Center

At a town hall meeting in August (East Cobb News post here), East Cobb commissioner Bob Ott said he was reviewing operations at the East Cobb Government Service Center to find cost savings.

That was in response to a proposal by East Cobb’s other commissioner, JoAnn Birrell, to close the East Cobb Library (which didn’t happen when the commission adopted the FY 2018 budget a couple weeks ago), and due to a $21 million budget gap.

The review has been complete, and Ott said on Friday that he is proposing a restructuring of the East Cobb Government Service Center (4400 Lower Roswell Road) that he will present formally at a commission meeting Tuesday.

In his weekly e-mail newsletter, Ott said he is recommending to close the business office only at the government center (where you pay property taxes and water bills and apply for business licenses).

Everything else will remain open—the Cobb police and fire precincts, the community rooms and the tag office. In his proposed changes, Ott wants to transfer the services provided at the business office (except for the water bills) across the hall to the tag office. Here’s what he’s sharing with the public for now:

“As a result of discussions between staff and Carla Jackson, Cobb County Tax Commissioner, those services will be available in the tag office. So, if you pay your property taxes or renew your business license at the government center you will still be able to just in a different location.  Some have expressed concerns about potential lines and wait times. This year when I renewed my vehicle registration there were only three people in the line so I don’t anticipate long lines after the restructuring.
 
“The only service which will not be available at the tag office is paying your water bill. Currently, there are approximately 150 people using that service which makes it hard to justify $200,000 in expenses. Additionally, everyone can pay their water bill online if they don’t want to mail in their payment.

“As you can see, for most in East Cobb the restructuring will mean little change.”

There is a proposal at Tuesday’s commission meeting to divert nearly $95,000 from the government service center operations to fund increased operating expenses of the soon-to-open Sewell Mill Library and Cultural Center.

The agenda item (pp. 238-240) includes the addition of one full-time and five part-time staff for the new facility, which is replacing the East Marietta Library and is slated to open in December. There also are four new staff positions listed under the Cobb Parks and Recreation  budget for cultural center operations.

The commissioners did not include funding for the new library when they adopted the budget, saying they would return to resolve the issue this month. The transfer of $94,491 from the government service center budget would make the proposed new library funding total $284,227 for FY 2018.

After a lengthy public hearing and discussion and the possibility of not approving a budget today, the Cobb fiscal year 2018 budget was adopted by the Board of Commissioners.

The $403.4 million budget is based on the millage rate of 6.76 set by commission in July, and using $19.7 million in contingency funding—”one-time monies” in budget parlance—to balance the budget. More than $1 million for Cobb community charities was not included in the budget, and representatives of many of those organizations were vocal about keeping their funding.

The new budget includes funding for the East Cobb Library, which commissioner JoAnn Birrell had proposed closing, but does not include funding for the Sewell Mill Library and Cultural Center, which will replace the East Marietta Library and is slated to open this winter.

Like the funding for the charities, funding for the new library is expected to be taken up by the commissioners in the new fiscal year, which begins Oct. 1.

What follows is a live-blog format of the public comment period, both from the public and the commissioners, that was updated as the budget proceedings took place.

1:41 PM: The budget passes 3-2, with Boyce, Birrell and Bob Weatherford voting yes, Ott and Cupid voting no.

1:28 PM: Chairman Mike Boyce is the last member of the board to speak, saying “budgets are never easy.” Regarding the non-profits, he said many provide services that government should be doing, but they do it better. “This isn’t black and white. The bottom line is we can’t give you what we don’t have . . . money because of the millage rate.”

Carving out a budget based on a 6.76 millage rate includes figuring out how “to provide services this county has come to expect.” He said “we’re a five-star county” and that he hopes conversations over the next few months will result in some kind of consensus from the board in the future.

1:15 PM: South Cobb commissioner Lisa Cupid said the budget situation today is “the direct result of the millage rate vote [from earlier this summer] that I did not support.” She also said that the situation is “not only mind-boggling but somewhat shameful,” and cited cuts in assistance to community non-profits, the continued limited hours for libraries and more.

“This is a not a good situation that we’re in today, to not pass a budget” that will “put us in a worse situation. There are real people with real needs that are attached to” what is tied into the budget.

She also referenced how the needs of the Braves are being accommodated, but not those who benefit from community charities. “I’m just troubled by this whole ordeal.” Cupid said she cannot support the budget proposal.

1:08 PM: The public hearing is closed, and the commissioners are making some opening comments during their discussion period. Northeast Cobb commissioner JoAnn Birrell said: “Is this a perfect budget? No. But is pretty much a flat budget” and she supports it.

East Cobb commissioner Bob Ott said he would like to see some details on how to deal with the one-time money, but “I don’t see it there.”

1:01 PM: Michael Paris of East Cobb, head of the Council for Quality Growth, spoke in support of the proposed budget. “Go forward and make sure we continue to make this county great,” he said.

12:29 PM: Ray Thomas, a South Cobb resident, expressed concern that the budget proposal includes contingency funding despite an improving economy and rising Cobb tax digest. “What happens when things really get tough? . . . This is very disconcerting.” He said the county has two choices: cut back services or find more revenue, and he cited a rise in the millage rate.

12:23 PM: Dan Daniel, a longtime East Cobb resident and volunteer at the East Cobb Library, pleaded with the commissioners to keep that branch open. If it closes, he said, nearby residents would have to go a great distance to patronize the library system.

12:01 PM: The public hearing on the budget is continuing, but we’re taking a break. This very well may be an all-day meeting, given what else is on the agenda, and what looks to be a commission impasse on the budget. Some very impassioned speakers already, and there are more to come.

11:22 AM: The directors of a number of community service organizations, including MUST Ministries, Family Promise of Cobb County and the Cobb Schools Foundation, are speaking on behalf of continuing the county funding they receive. The proposed budget does not include charities funding.

A retired citizen, John Morgan, asks the commissioners to consider “what will your legacy be?” especially as it pertains to Cobb’s homeless, and cites several Bible passages. The crowd applauded as he concluded.

11:05 AM: The first speaker is East Cobb resident Abby Shiffman, the chairwoman of the Cobb library board of trustees, and she’s urging the commission not pass a budget today, especially as it pertains to the library budget. “How can you pass a budget without specifics?” she asked, noting that the library system has suffered “cut after cut after cut” with no increase in funding, including expansion of library hours, since the recession. The notion of closing a library branch (Birrell has proposed closing the East Cobb Library) “without a true hearing is something I cannot understand.”

BTW: Tonight is the Cobb Library Foundation’s gala dinner, “Booked for the Evening,” featuring East Cobb author Jonathan W. Jordan, that’s one of the year’s biggest fundraising events for outside money to support the library system.

Cobb 2018 budget adoption, 2040 comprehensive plan on Friday agenda

A postponed meeting from last week that was to include the Cobb 2018 budget adoption and the Cobb 2040 Comprehensive Plan will take place Friday.

The Cobb Board of Commissioners will meet starting at 10 a.m. in the 2nd floor room of the Cobb BOC building, 100 Cherokee St., in downtown Marietta.

The meeting was rescheduled because county government was shut down due to Tropical Storm Irma. Before commissioners vote on the fiscal year 2018 budget, a final public hearing on the budget will take place.

Cobb commission chairman Mike Boyce has proposed an $890 million budget (PDF here), with $405 million for the general fund, and without a millage rate increase. After losing a battle in July to boost the millage rate to fully fund the 2008 Cobb parks bond referendum, Boyce is proposing to use $21.5 million in contingency funding to balance the budget.

He’s also been feuding with his fellow East Cobb commissioner, JoAnn Birrell, who has proposed closing the East Cobb Library to help balance the budget. At an August town hall meeting at that same library branch—the second-busiest in the Cobb public library system—Ott said he would propose closing an “underperforming” branch elsewhere in his district but has not publicly elaborated since then (East Cobb News post here).

East Cobb residents spoke out loudly at a previous public hearing before Birrell defended her proposal to close the East Cobb Library. More than 5,000 people have signed an online petition to keep it open.

Addoption of the Cobb 2040 Comprehensive Plan is on Friday’s agenda, which reflects “Cobb’s vision, policies and goals based on the existing plan and community involvement,” according to documents explaining the plan update process.

Hearings, revisions and other work going into the 2040 plan have been ongoing since 2015. The final draft was completed on Sept. 5, with final revisions explained here.

Several East Cobb citizen activists have been critical of the proposed Cobb 2040 report, concerned about the influx of high-density development in the East Cobb area.

The county is required by the state to adopt a plan and submit it for review by the Atlanta Regional Commission.

Also on Friday’s agenda are the following East Cobb-related items:

  • A change order to approve $194,700 in funding to resurface Dickerson Road, located off Lower Roswell Road, where a new subdivision, Crossvine, is being built by Lynwood Development;
  • An appeal by the owner of a proposed bar in northeast Cobb whose application for a liquor license was denied. Naseeb Rana of Kasbah Corp. wants to open an establishment in the Sandy Plains Village shopping center called Paprik’a which would have outdoor seating close to residential homes. Citizens from the Chatsworth and other subdivisions have strongly protested the application, saying the noise and late hours are incompatible with the community. They also said other establishments in the area serving alcohol are all-indoors and that Rana has not been responsive to community concerns;
  • East Cobb resident Ross Cavitt is expected to be appointed Cobb communications director, after more than 20 years as a reporter at WSB-TV (East Cobb News post here.)

Ott opposes raising millage rate to close $21M Cobb budget gap

This shouldn’t come as a surprise: Cobb Commissioner Bob Ott is opposed to raising the millage rate to balance the fiscal year 2018 Cobb County budget.

With commissioners scheduled to adopt a budget next Thursday, Ott sent out a lengthy message right before the Labor Day holiday weekend explaining why he would not support a rise in the property tax millage rate to cover an estimated $21 million shortfall.

Commission chairman Mike Boyce has proposed an $890 million spending package (PDF here) that includes using contingency funding to close the entire deficit gap.

In July, Ott helped foil Boyce’s plan to raise the millage rate to fully fund the $40 million 2008 Cobb Parks referendum (East Cobb News coverage here).

The proposed FY 2018 budget would be balanced by using reserve funding from the following sources:

  • $10.4 million from the reserve for a county employees pay and classification implementation study;
  • $5.7 million from the county Title Ad Valorem Tax Reserve;
  • $5.3 million from the county economic development contingency.

Ott, who’s been vigorously opposed to property tax increases in general, said he can’t support raising the millage rate now, for a full fiscal-year budget, with contingency money available. In his weekly e-mail newsletter that came out on Friday, he said:

“I believe it is wrong to raise the millage rate before the BOC uses the money from these funds to pay-down the deficit. Together, at their height, these funds totaled approximately $22 million being held in reserve on top of the county’s ‘normal’ reserve funds.”

He also hinted at this position at an Aug. 17 town hall meeting at the East Cobb Library, just days after the budget was revealed, telling constituents “it’s your money.”

In his Friday e-mail, Ott urged finding ways to reduce expenses in some county services, including two familiar targets of his, the annual transfer of Cobb water system revenues to the general fund, and transit subsidies:

“I don’t believe the answer to addressing this $21 million deficit is simply an increase in the millage rate. A complete review of the budget and expenses should be done to identify and eliminate wasteful spending. Two areas that I believe illustrate inefficiencies in the budget are the need to transfer $20 million per year from the Water System to the general fund and the roughly $17 million a year subsidy of the county transit system. CobbLinc provides invaluable service to many county residents. However, many buses travel the routes virtually, if not completely, empty.”

Ott’s also been in a budget fight on another front, with fellow East Cobb commissioner JoAnn Birrell, who is proposing to close the East Cobb Library, citing duplication of services.

After hearing from upset East Cobb residents opposed to shuttering the second-busiest branch in the Cobb library system, Birrell defended her proposal at an Aug. 22 public hearing on the budget. She cited a recent report calling for more police officer hires in Cobb (Birrell has long wanted to create a new police precinct in Northeast Cobb) and said she wants to be good steward of taxpayer money.

At his town hall, Ott said he is considering moving some services at the East Cobb Government Service Center to the East Cobb Library and possibly closing an “underperforming” library elsewhere in his district, but he hasn’t elaborated.

Just a few days after seeing the proposed fiscal year 2018 Cobb County budget for the first time, commissioner Bob Ott briefed East Cobb constituents on the numbers Thursday night and offered some suggestions that could punctuate budget discussions over the next few weeks.

At a packed town hall meeting in the community room of the East Cobb Library, Ott outlined the $890 million spending plan proposed by commission chairman Mike Boyce, including using $21.5 million in one-time reserve funding.

The Cobb Board of Commissioners will hold the first of two public hearings on the budget on Tuesday before approval on Sept. 12. That’s not much time to absorb a proposed spending package that’s 3.79 percent higher than the FY 2017 budget, and only weeks after a heated battle over the property tax millage rate.

The budget document also was released this week [there’s a downloadable PDF here] as Cobb homeowners were mailed their property tax bills for 2017. As Ott reminded them, “the tax bill you just got is to pay for [the last fiscal] year.”

The proposed budget is based on the current millage rate established by commissioners last month. Ott and fellow East Cobb commissioner JoAnn Birrell prevailed in their refusal to raise the millage rate by 0.13, as Boyce had wanted.

The inclusion of the proposed reserve funding to help balance the budget is a dramatic one. A total of $10.4 million would come from the reserve for a county employees pay and classification implementation study; $5.7 million would come from the Title Ad Valorem Tax Reserve; and the $5.3 million would come from the county economic development contingency.

“The board has to decide what are the critical needs,” Ott said. “The bottom line is, it’s your money.”

Specifically regarding the reserve money, Ott, an ardent opponent of tax increases, repeated himself: “It is my belief that it’s your money,” and that there’s “no reason” for it to remain unspent and raise taxes instead.

Cobb commissioners set public hearing dates for fiscal year 2018 budget

A contentious process over setting the county property tax millage rate has just ended for the Cobb Board of Commissioners, and a new budget process is about to begin.

The commissioners will hold public hearings as they begin work on the fiscal year 2018 budget, which takes effect Oct. 1.

The budget will be formally presented during a special called work session at 8 a.m. on Tuesday, Aug. 15, and public hearings will take place during regular commission meetings at 7 p.m. on Aug. 22 and at 9 a.m. on Sept. 12, the date the budget is expected to be adopted.

All hearings and meetings will take place in the 2nd floor board meeting room in the Cobb BOC building, 100 Cherokee St., downtown Marietta.

The budget proposal will be made available online, in the Cobb finance office, also located at 100 Cherokee St., and at the Cobb Superior Courthouse, 70 Haynes St., also in downtown Marietta.

Last month, the commission voted not to raise the 2017 millage rate, as Chairman Mike Boyce had proposed, after plenty of opposition from residents (see previous East Cobb News coverage here and here.)

The last-minute decision to keep the millage rate the same was engineered by East Cobb commissioner Bob Ott, who is holding his next town hall meeting on Aug. 17 at East Cobb Library.
